Probation Violation

If a motion is filed to revoke your probation, you have no right to a jury trial to contest the allegations. It is the judge who will hear the evidence. The State also does not have to prove the allegations beyond a reasonable doubt, only by a preponderance of the evidence, which is a lower standard. 

The consequences of a revocation can be very severe. If your probation is revoked, you could be facing a conviction on your record for the rest of your life and the possibility of going to jail or the penitentiary. In addition, depending upon the type of probation you are on, you may not be entitled to a bond.
